Terms & Conditions
1. PROVISIONS. Iron Physique Gym will provide a fully equipped facility including a fitness training area with cardio equipment, stationary equipment, and free weight training area. IPG may be unavailable during a period of repair and maintenance, special events, programs, or by Management’s schedule for these events. In order to keep the facility in the best possible condition a portion of IPG may be closed for a temporary time period for repairs, renovations, or general cleaning. There will be no adjustment in dues for this period of closure.
2. LIABILITY AND WAIVER OF LIABILITY. Each member of IPG shall be liable for any property damage and/or personal injury (caused by the Member, Member’s Family, Guest, or any other person) at the IPG Club or any activity or function operated, arranged, or sponsored by the IPG Club. It will be the responsibility of the member to pay for any costs involved upon presentation of a statement thereof. Any and all use of the IPG Club facilities, or participation in, shall be AT SUCH PERSON’S OWN RISK. The IPG Club shall not be liable for any injuries or damage to such person, or the property of such person. IPG shall not be liable or subject to any claim, demand, injury, or damages to such person, or the property of such person. The Member individually, and on behalf of the Member’s personal administrators, representatives, heirs, assigns and successors does hereby expressly forever release and discharge the IPG Club, its successors, and assigns, as well as its officers, agents, and employees from any/all claims, demands, actions, or causes of action.
3. SUSPENSION/TERMINATION OF MEMBERSHIP BY MANAGEMENT. Management has the right to suspend and/or terminate any membership for non-payment of dues, fees, for behavior detrimental to the equipment, or for behavior detrimental to the enjoyment of the IPG Club by other members and staff for any reason deemed sufficient in the sole discretion of Management. 4. CANCELLATION AND REFUNDS. If you decide to cancel your membership, you may do so by notifying IPG via email or at the front desk. You then will be required to fill out a cancellation form.
5. AUTOMATIC RENEWAL. Members must notify staff in order to cancel or suspend their membership. If not, their monthly membership will continue to renew every month.
6. UNPAID BALANCES. All balances which are 30 days past due are subject to a $10.00 monthly service fee. In addition to other rights, Management reserves the right to collect the current and past due balance, suspend and/or terminate membership privileges, recover from Member(s) any collection fees, court costs, and reasonable attorney’s fees agreed to be 30% of the entire balance due and owing, collect a service fee of $30.00 for any check or draft payable to the IPG Club which is not honored.
7. ENHANCEMENT FEE. In order to continually update and maintain the IPG facilities, an automatic annual fee of $30.00 will be charged to your account. All member(s) who signed up for membership between October and March will have this fee withdrawn from the member(s) account on April 15th of the contracted year. All member(s) who signed up for membership between April and September will have this fee withdrawn from the member(s) account on October 15th of the contracted year. This fee will not have tax included, so the total amount for the membership will increase when tax is added in. If any member or members decide to pay for their membership in full for the entire year or two years, this enhancement fee will be an additional fee when purchasing the membership All memberships that are up for renewal on the date of the enhancement fee withdrawal, is subject to pay this enhancement fee, unless member spoke, emailed, or wrote a letter to management describing reason for non-payment of this fee. This fee will be directly put back into upgrades and enhancements within the facility. Non-receipt of club enhancement dues will result in an infraction of membership that will be subject to additional charges.
8. REFERRALS. Members must refer 5 new memberships within a calendar year. Discounted promotional rates do not count towards referrals. All referrals must remain active and up to date on all past due balances or late fees that are still owed – to be eligible for this program. If you do become eligible for a free year at Iron Physique Gym, then you must speak to Management. Although you may be eligible for a free year, your account must be paid off from all past due balances and late fees before granting the new membership. A valid credit, debit, or checking account must remain on your account. If the payment method is removed, declines, or becomes invalid, the free membership shall be terminated by Management and will be subject to pay original membership prices and/or will be charged through the account on file. You will be responsible for any add-ons, personal training, or anything above and beyond basic membership access. This cannot be transferred between participating locations.
